This page contains links to information on cases coming before the Planning and Zoning/Local Planning Agency, Hearing Examiner, and/or City Council. The City's Hearing Examiner meets on the first Tuesday of the month.  The Planning and Zoning/Local Planning Agency meet on the first Wednesday of every month. Occasionally, there are special meetings held.

The Planning and Zoning/Local Planning Agency is the recommending body for Future Land Use Map Amendments and Comprehensive Plan Text Amendments.  The Planning and Zoning/Local Planning Agency is also the recommending body for revisions to the Land Use and Development Regulations and Annexations.  

The Hearing Examiner is the final decision-making authority for the following cases: Appeals to Administrative Decisions, Special Exceptions, Marine Improvement Deviations (Docks), Variances, Non-Conforming Structure Special Exceptions (NC SE), Landscape Deviations, South Cape Redevelopment Incentive Program Applications, Non-Residential Design Standard Deviations, and some Planned Development Projects.  The Hearing Examiner is the recommending body for Vacations of Plat, Zoning Amendments, and some Planned Development Projects.

The ordinance is a city-initiated comprehensive plan text amendment to Policy 1.15 of the Future Land Use Element and establishes Policy 1.15.s, the Mixed Use Ten (MX) future land use map classification within the Comprehensive Plan.

The purpose of the MUX is to encourage planned unit developments that include more than one type of use.  Uses permitted include residential, retail, office, service, light manufacturing, institutional, residential within mixed-use buildings, larger scale commercial retail, and public facilities.  Residential densities are up to 50 units/acre, while non-residential intensities are permitted up to a floor-area-ratio of 3.0. Development is required to undergo the Planned Unit Development (PUD) process and the minimum development size is 10 acres.  Development may consist of 100% non-residential uses.  Standalone residential uses are limited to 50% of a development in the MUX, as measured by development acreage. Properties that would be mapped with the MUX future land use must have utilities on-site, must be in an area scheduled to receive utilities within 3 years of application, or must be in an area subject to a utility agreement between the developer and the City to provide centralized utilities to the site.

This ordinance does not affect the Future Land Use Map or Zoning Map. If approved, there may be future land use map amendment and rezone amendments that will be initiated by the City or by private applicants.  The proposed amendment addresses mixed-use development for larger, unplatted tracts. Providing guidance that balances residential opportunities with non-residential needs of the community is the purpose of the amendment.

The applicant requests a future land use map amendment from the Lee County future land use designations of RS-1 and Intensive Development to the City of Cape Coral future land use designation of Commercial/Professional (CP). The site is six parcels, totaling 1.02 acres, and was annexed into the City of Cape Coral in 2022.  The amendment is the 2nd step in developing the property within the City. The applicant will also need to apply for a rezone as the last step for future development.

Amends the Infrastructure Element in preparation to incorporate the updated Water Supply Facilities Work Plan into the Comprehensive Plan.  The Work Plan was updated in 2024 to reflect the SFWMD change to their water supply plan.
