Public Hearing Information
The Planning and Zoning/Local Planning Agency is the recommending body for Future Land Use Map Amendments and Comprehensive Plan Text Amendments. The Planning and Zoning/Local Planning Agency is also the recommending body for revisions to the Land Use and Development Regulations and Annexations.
The Hearing Examiner is the final decision-making authority for the following cases: Appeals to Administrative Decisions, Special Exceptions, Marine Improvement Deviations (Docks), Variances, Non-Conforming Structure Special Exceptions (NC SE), Landscape Deviations, South Cape Redevelopment Incentive Program Applications, Non-Residential Design Standard Deviations, and some Planned Development Projects. The Hearing Examiner is the recommending body for Vacations of Plat, Zoning Amendments, and some Planned Development Projects.

This vacation was initiated by the owners of property at 1933 se 2nd street. They are requesting to vacate 2,000 square feet of street right-of-way on a hammerhead cul-de-sac between their property and 204 SE 20th Place. The vacation will enlarge the area of both properties. Additionally, 354 sq. ft. of platted easements are requested to be vacated on Lots 1 and 2, Block 1339 and 354 sq. ft. of platted easements on Lot 32, Block 1338. The vacation will provide the owners of 1933 SW 2nd Street with greater flexibility in designing and constructing a new single-family home and driveway on the site. Underlying easements in the vacated right-of-way will be retained by the City. The applicants are seeking a rezone of 14 parcels in Block 2378 on NE 4th Terrace, from Single Family Residential (R1) to Commercial Corridor (CC) zoning. This application contains majority ownership control from the landowners (9 of 14 parcels) as shown in Exhibit “A.” LDC, Section 3.4.6.A.3. allows property owners of at least 51% of the land area to apply for a rezone. Together the 14 parcels total about 3.64 acres. The parcels currently have R-1 zoning that is inconsistent with the PIRD Future Land Use Classification (FLUC. Surrounding zoning can be found in Table 1 below. The applicants request to amend the zoning to bring the new CC District into consistency with the PIRD FLUC so that the properties may be developed. |
