PUBLIC NOTICE: FEMA Public Assistance Program

FINAL PUBLIC NOTICE

The Federal Emergency Management Agency (FEMA) has received the subgrant application for the City of Cape Coral seawall repairs at the Everest Complex due to damages in Hurricane Irma (DR--4337-FL PW 06394). Pursuant to Executive Order 11988 and 44 CFR Part 9.12, final notice is hereby given of FEMA’s intent to provide funding for this project under the Public Assistance (PA) Program.

An initial disaster-wide Public Notice was published October 6, 2017 for Hurricane Irma. Comments and other information received were fully evaluated by FEMA along with evaluation of social, economic, environmental, and safety considerations. This notice serves as a project-specific final notice for FEMA’s funding action located within the wetland.

Funding for the proposed project will be conditional upon compliance with all applicable federal, tribal, state and local laws, regulations, floodplain standards, permit requirements and conditions. This action complies with the National Flood Insurance Program (NFIP) requirements.

Floodplain/Wetland: Project is located in a shaded X zone, otherwise known as the area inundated by the 2% annual chance of flooding, per Lee County FIRM Panel #12071C0405F, dated 08/28/2008. Review of the National Wetland Inventory (NWI) online mapper, accessed on 07/08/2019, indicates portions of the project are located within a designated wetland (E1UBLx), otherwise known as an estuarine and marine deepwater wetland.

Proposed Work and Purpose: The City of Cape Coral proposes to replace 300 LF of pre-existing seawall panels with reinforced concrete panels. The City of Cape Coral will also utilize 183 CY of infill behind the panels, and no rip-rap would be placed on the wet-face side of the seawall. The repairs proposed restore the structure back to its pre-disaster design, function and capacity within the existing footprint.

Project Alternatives: The alternative that has been considered is the no action alternative. This alternative is not feasible as the area will remain vulnerable to shoreline instability, including property damage and hazards to human life and safety. With the no action alternative, continued negative impacts on adjacent infrastructure, property, residents, and the community may be experienced. Alternate locations were not considered as relocating the structure outside of the wetland is not feasible as the seawall is functionally dependent upon its location in the wetland.
