Public Hearing Information


This page contains links to information on cases coming before the Planning and Zoning/Local Planning Agency, Hearing Examiner, and/or City Council. The City's Hearing Examiner meets on the first Tuesday of the month.  The Planning and Zoning/Local Planning Agency meet on the first Wednesday of every month. Occasionally, there are special meetings held.

The Planning and Zoning/Local Planning Agency is the recommending body for Future Land Use Map Amendments and Comprehensive Plan Text Amendments.  The Planning and Zoning/Local Planning Agency is also the recommending body for revisions to the Land Development Code Regulations and Annexations.  

The Hearing Examiner is the final decision-making authority for the following cases: Appeals to Administrative Decisions, Special Exceptions, Marine Improvement Deviations (Docks), Variances, Landscape Deviations, Non-Residential Design Standard Deviations, and some Planned Development Projects.  The Hearing Examiner is the recommending body for Vacations of Plat, Zoning Amendments, and some Planned Development Projects.

The applicant is requesting a future land use map amendment from Single Family (SF) to Public Facilities (PF) for three sites in central Cape Coral totaling 4.52 acres as more particularly described in Exhibit “A.”

The applicant requests a future land use map amendment for two City-owned parcels in Southwest Cape Coral. The amendment will amend one parcel from the Public Facilities (PF) future land use designation to the Parks and Recreation (PK) designation and will amend one parcel from a Lee County designation – Rural - to the PK designation. The latter parcel was annexed into Cape Coral in 2024 and has retained a Lee County future land use designation.

This case involves a City-initiated large-scale Future Land Use Map Amendment for one publicly-owned property (2.54 acres) from Mixed-Use (MX) to Parks and Recreation (PK). The site is developed with park facilities.

The proposed amendment would legalize the existing parkland uses.

This is a small-scale City-initiated request for an amendment to the Future Land Use Map where  the City is the property owner.

The applicant has requested an amendment to the Future Land Use Map, amending the current Commercial/Professional (CP) land use to a proposed Public Facility (PF) land use for a single parcel totaling +/- 582,988 SF or 13.38 Acres.

The applicant requests a rezone from Single-Family Residential (SF) to Commercial (C) for one parcel totaling 69,944.56 sq. ft. The parcel is undeveloped. The site is at the intersection of Santa Barbara Boulevard and Kismet Parkway. The site’s future land use designation was amended to Commercial/Professional (CP) in 2024.

Ordinance 29-26 amends Section 4.1.5. of the Land Development Code entitled “Projections and encroachments into setbacks.”  This ordinance will provide greater flexibility to homeowners for installing generators, pool equipment, and heating, ventilation, and air conditioning equipment by eliminating the current requirement that these types of equipment must be located within five feet of the building envelope.  The proposed amendment will allow these types of equipment to be placed in the side and rear yards of residential-zoned sites provided the equipment does not encroach into a public utility and drainage easement.  This issue was previously discussed at two Committee of the Whole Meetings on February 25 and May 8.  Following the May 8th meeting, Planning staff was directed to bring an amendment forward for the City Council to consider.  Staff recommends approval of Ordinance 29-26.

1. Vacate 5,100 sq. ft. of alley right-of-way and 4,860 sq. ft. of underlying easements between Lots 1 - 6 and Lots 43 - 48.

2. Vacate 1,458 sq. ft. of platted public utility and drainage easements along the south property in Lots 1-6.

3. Vacate 1,458 sq. ft. of platted easements along the north property line of Lots 43-48.
